(LE MARS)–A dispute over a lease for a city of Le Mars facility may be heard by a Plymouth County district court judge this month.
Mark and Tobi Ellis operated Willow Creek Watering Hole and Plymouth Ice Cream Company as tenant of the city’s golf clubhouse bar facility in 2009.
In legal action, the Ellis’ state they complied with the lease and paid rent through January of this year. The city sent the operators notice in December that the lease would not be automatically renewed. The locks on the clubhouse were changed at the end of last year.
The city council received a recommendation for a new operator after the city advertised for proposals. A contract with Mike Fiddelke of Orange City was signed earlier this year.
According to Plymouth County district court records, the Ellis’ claim breach of contract and have asked for a temporary and permanent injunction preventing the city from leasing to someone else.
The city’s attorney, Joe Flannery, answered the Ellis’ legal action stating they did not fulfill the lease agreement with the city. The city claims examples of this included lease requirements for special events, timely accounting of business profits, and working arrangements with the golf pro, his staff and Visitor Bureau Manager.
(LE MARS)–Tenants that rent space at the Le Mars Community School District’s Education Service Center are renewing their leases.
The Le Mars Community School Board of Education considers the leases with Buena Vista University and Northwest Area Education Agency tonight.
The board will consider contracts with Dave Winslow for middle school science, Ron Hayden as a bus driver and Todd Wendt for superintendent for the coming school.
Elementary and Middle School Principals are slated to present their annual reports.
The board is expected to close a portion of its meeting to the public to consider a recommendation to suspend or expel a student. According to the agenda, the board will return to a session open to the public to act on the recommendation.

(ADAVILLE)–Merrill and Hinton Fire Departments responded to a report of a fire at Adaville Saturday morning.
The fire was in the parsonage of the Adaville United Methodist Church, rural Merrill. The parsonage is unoccupied.
KLEM incorrectly reported Sunday that the fire was in the church.
(SHELDON)–A Le Mars man is a big winner in a record setting fund raiser for Village Northwest Unlimited in Sheldon.
The fifth annual benefit run, walk and roll had a record turnout and a record 31-thousand dollars raised from registrations, sponsorships and donations .
There were 80 runners with David Bohlken of Le Mars winning the men’s 10-K for the second consecutive year with a time of 36:09. Bolken competed in the 20-29 year old category. First place in women’s 5-K went to Nichole Duncan of Hartley.
A portion of the record proceeds will be use to buy a wheelchair accessible shuttle golf cart.
(ORANGE CITY)–A Sioux Center man is in jail after his arrest for felony identity theft and forgery charges.
The Sioux County Sheriff’s office charged 22-year-old Waldemar Lopez-Gonzalez Friday afternoon.
According to written information from the sheriff’s office, Lopez-Gonzalez was arrested after a traffic stop. Authorities claim Lopez-Gonzalez was using another person’s identity to work at Golden Crisp in Sioux Center.
He is charged with identity theft, forgery, failing to have a driver’s license and failing to have motor vehicle insurance.
MILBANK, S.D. (AP) South Dakota authorities say a 58-year-old man from Jackson, Neb., was fatally injured when a piece of equipment fell off a forklift and struck his head.
Grant County Sheriff Mike McKernan says a loader frame was being moved off a semitrailer when it toppled off the forklift and struck the man. The accident occurred at Schuneman Equipment in Milbank on Friday morning.
The man was the driver of the semitrailer and had delivered the loader frame.
The sheriff said Friday that the man was pronounced dead at Milbank Area Hospital Avera.
A spokesman for the sheriff said Saturday that the man’s name has not been publicly released yet.

DES MOINES, Iowa (AP) The Calhoun County Sheriff’s Office has identified the three people who were found dead in a farmhouse in rural western Iowa.
The sheriff’s office released a statement Sunday morning identifying the people as 19-year-old Paige Gallo of Council Bluffs, 20-year-old Heather Campbell of Urbandale and 20-year-old Luke Schleisman of Lake City.
The sheriff’s office says autopsies were done on the three Saturday and more details of the investigation will be released later in the week.
Officers found the bodies early Friday after responding to a report of a possible disturbance.
Sheriff Bill Davis has declined to say whether the case is being treated as a homicide.
BURLINGTON, Iowa (AP) Authorities say four fire departments responded to the Alliant power plant in Burlington after a report that coal began spontaneously smoldering.
Officials say workers at Alliant on Saturday found the smoking coal, which was being brought into the power plant on an underground belt. The coal smoked and steamed but didn’t catch fire. Officials say no injuries were reported.
Alliant spokesman Ryan Stensland says fire departments are always called when coal starts to heat up to make sure that it can be cooled. Fire crews from Burlington, West Burlington, Danville and Wever responded.
Alliant workers moved the coal around with heavy machinery to eliminate hot spots.
Stensland says Alliant plans an internal investigation of the incident.
IOWA CITY, Iowa (AP) Starting this fall, the University of Iowa will begin offering a Certificate in Leadership Studies to all of its undergraduate students.
Kelley Ashby is director of the Career Leadership Academy at the school’s career center, which will administer the certificate program. Ashby says the certificate can make Iowa graduates stand out when they’re looking for jobs.
The certificate requires 21 hours of coursework and students will have to complete a hands-on project. Ashby says students studying in any discipline at the university can earn the certificate.
The aim is to teach students skills like management, coordination, communication and acting with integrity.
MASON CITY, Iowa (AP) Residents in Mason City are complaining about ruckus-causing raccoons.
Mason City councilmember Janet Solberg says she’s receiving calls about raccoons. Mason City Animal Control has been picking up raccoons caught in cage traps. They’re usually released at Lime Creek Nature Center.
Experts say the best way to keep a raccoon from coming near homes is to eliminate any food sources.
Ron Andrews is an animal specialist with the Iowa Department of Natural Resources. Andrews says for many years Iowa has seen a “bumper crop” of raccoons. He says they’re very adaptable to living in different areas.
NEW HARTFORD, Iowa (AP) New Hartford is getting a convenience store about two years after a tornado and flooding prompted the last one to close.
Joe Simon of Parkersburg says he plans to begin work this month on a $1 million store with gas and diesel service on the southwest side of New Hartford. He hopes to complete the project this fall.
The last convenience store and gas station closed after a huge tornado in May 2008 swept through the community, killing two people in New Hartford and six in Parkersburg. That was followed by severe flooding.
WEST DES MOINES, Iowa (AP) Great Britain’s Tim Don overtook the field with a strong closing run to win the Hy-Vee ITU Elite Cup Triathlon in West Des Moines.
Australia’s Emma Snowsill took home top honors in the women’s event, winning in 1:59.35. Don and Snowsill each pocketed $200,000, the world’s largest winner’s check for a triathlon.
Don won in 1:50.20, four seconds ahead of New Zealand’s Kris Gemmell.
Snowsill, the Olympic gold medalist in Beijing two years ago, crushed the field during the final two laps of the run and won by 16 seconds. It was the second win in Iowa for Snowsill, who also took home the sport’s richest prize two years ago.
